FROM KAIT'S MOM ON THE ANNIVERSARY OF HER MURDER
 
Question: Tonight, Kait's dad and I sat, holding hands, over the candle we lit to bring light to her spirit. As we do every year at this time, we talked to her.

What I said was, "I'm sorry I've fallen down on you. On your 21st birthday, I stood at your grave with the manuscript of WHO KILLED MY DAUGHTER? in my hands and said, "This is your present, honey. Mother is going to find your killer."

APD has prevented me from doing that. And, Daddy and I have discovered that there's no way that a case can be solved if the law enforcement agency who controls the case doesn't want it solved.

For some reason, APD does not want Kait's case to be solved. After years of private investigation and much information from informants, we've come to realize that someone within the department was involved, if not in the murder, then in the cover-up.

This has created a cement wall of Blue Solidity against which we can only butt our heads over and over again unless somebody out there who knows and truly does care will give us the help we need to expose not just the killer but the reason for the cover-up. The latter may be more important than the former, if the killers were hired hitmen.

Kait, I failed you. I'm sorry.

Reply: We didn't report the theft because at the time it took place we didn't know about it. During that traumatic period, the last thing on our minds was viewing videos.

We discovered the missing videos in 1992 when"Unsolved Mysteries" wanted to view one so they could cast the character of Kait in their re-enactment. We opened the box in which we'd placed all the videos that were in our home at the time we relocated, and all the ones with Kait on them were missing.

We know when the theft must have taken place. After receiving anonymous death threats, we spent a couple of months in a rented apartment with a security system before having our belongings packed up for storage and putting our family home on the market. During that interval, all our belongings were unguarded in a vacant house.

Kait had a key to our home on her key chain, along with all her other keys, including her car key. Anyone who had access to that bunch of keys could have reproduced the house key.

Question: Alejandro Marentes or Alex runs a photography business in Albuquerque, "buggs photography".

But he was also at the scene but not on record is that corrrect? Could he have been the officer the wedding party saw?

Reply: We have been told that he was at the scene but not part of the records of attending officers. We have not verified that.

As for your second question -- anything is possible.

Question: The president of the Police Union who ordered officers to blanket the cops at Kait's scene was Alex Marentas. He was a field officer back then, so he could have been at the scene. Was he the boyfriend of Officer Mary Ann Wallace? If so that would explain a lot. Does anybody know if he was?

Reply: We were told so by the wife of a cop. (Of course, I won't reveal who she was.) But we have no varification of her information. Info from one other person would give us a second source so we could take this seriously

You're right. If true, it would explain a lot.

His personal web site, which he's now taken down, did state that he was a field officer at that time. But did not reveal his romantic past.

Question: The angle of the bullet hole looks like it was fired straight in. Not at an angle. I'm not a cop but it looks like it wasn't fired at an angle towards the driver.

Question: The poster on Officer Wallace has come up with an intriguing theory.

I have always felt Officer Wallace got her hands very dirty in Kait's murder, but couldn't come up with as good a theory as the previous poster has. It makes sense.

Question: She arrived within 40 seconds but what color were thw VW's that were witnessed? Could the first VW have come back or did apodaca arrive in another VW?
Its difficult to believe Wallace would have actually shot Kait but she would have COVERED for the shooter. Paul Apodaca?

Reply: Paul Apodaca has stated that his VW bug was orange. Mark Apodaca's VW Bug was yellow. The VW Bug the Vietnamese men were seen spray painting in Kait's parking lot the day after the shooting was tan (they were spraying it black). The witnesses who saw a VW Bug flee the crime scene and try to take refuge in the parking area of the auto body shop at 824 Arno thought the car was tan or gray. But it was night and that area was not well lighted. Any of those VWs might have looked tan or gray under those circumstances.

I, too, find it hard to believe that Officer Wallace would have shot Kait. But, yes, it seems possible Wallace could have covered for the shooter. She told our P.I. she was a personal friend of the APD narc who was the brother of Paul Apodaca's drug dealer, identified by Paul as Lee Padilla. Paul told our PI he was "in the area" that night to buy drugs from Lee. If Lee was one of the people in the VW Bug that night, Wallace might have covered for him. Cops do cover for each other and each other's family members.

Question: Could it be that officer Wallace went on record with her observations from her **FIRST** visit to the scene??Kait is pursued, shot at and run off the road in designated area by another car (not VW) although the VW is also involved and present and was witnessed by the man who heard the shots although he WOULD NOT have seen the police car but he HEARD THE SIRENS and that would have possibly been Wallace rushing to make sure Kait had been taken care of...because there would not have been sirens since this was not actually called in...especially RIGHT AFTER THE SHOOTING which is what the witness on Arno stated, that he heard sirens. Wallace arrives goes to the drivers side opens the door and sees that Kait is hurt and bloodied but NOT dead and upright, conscious, MOANING AND CRYING and puts the car in park.This is when the wedding party happened by and witnessed the officer standing at drivers side with head PURPOSELY turned away to obscure view.When they had passed Kait was pushed down and shot which would explain lack of blood on drivers side.The shoe outside of the car would indicate a STRUGGLE that more than likely would not have occurred with a stronger MALE.The door is shut and the officer leaves the scene only to magically appear within 8 seconds ofhearing it called in by Merriman but actually if she were that close she would have heard the shots and crash anyway, right?then Wallace instead of giving her SECOND account of the scene gave her first.Now if Wallace did not carry out the execution then it was Paul apodaca who returned to the scene (VW) and did it.

Reply: This is an interesting scenario. Remember, however, that more than one person involved with this case owned a VW bug. An Quoc Le, (Dung's alibi friend), is on record as having owned a VW bug at that time. Kait's neighbors saw Vietnamese men (friends of Dung's) spray painting a VW Bug in the parking area of her apartment complex the day after the shooting. Paul Apodaca owned a VW Bug, but HIS BROTHER, MARK APODACA, OWNED ONE AS WELL. (Mark is currently serving a lengthy sentence for murder.) One thing is for certain -- Paul Apodaca was not alone in a VW bug on the night of the shooting. At least one other person had to have been with him to have driven that car away between the time Det. Merriman spotted it there and minutes later, when Merriman made a U-turn and returned to the scene, to find Paul Apodaca there by himself and the VW Bug gone. The witnesses who saw the VW bug flee the scene stated it contained at least two people. That could have been Mark -- and one other.

Reply: Police have told us that it was the head of the police union who issued that order. Other cops have told us that same man was a field officer at the time of Kait's murder, was at the scene (although unlisted), and was at that time Mary Ann Wallace's boyfriend. We have no proof of this however.

Question: It seems officer Wallace made a STUNNING disclosure...if Kait was crying and moaning then she was completely ALIVE the FIRST TIME officer Wallace set upon her(witnessed by the wedding party) the second time (arriving in 8 seconds by chance??)she was unconscious witnessed by merriman. Their stories are not conflicting at all just different time frames. Wallace and Merriman were not lying about what they witnessed at all...

Question: I have been skimming over past posts and I was wondering about the woman who said she was raped by a cop. Other posters have alluded to her but I can't find her actual statement.

I remember her statement well, however, because she also sent it to us by private e-mail. Removing some personal references that might identify her, she basically said:

“There was a ABQ cop (and she identified him by name) who hung out at the Roadrunner Lounge on base next to the flightline. He was known to go to the after hours parties on Arno. He's a bad cop, he would follow women home from the club and sexually take advantage of them when they had too much to drink, knocking on the door and giving the answer "police officer" when asked who it was outside. I was one of those women. He placed his weapon on my bed and I was so scared that I just closed my eyes and waited for the nightmare to be over. He told me that no one would believe me if I called APD and they wouldn't care. Kirtland AFB was notorious for illegal drugs in the NCO club and there were cover-ups before HQ at Wright-Pat cleaned house on the commanders.”

It seems the only other state that even comes close to being as dirty is Louisiana.
I've been to both places and the officials in Louisiana are just mean and apathetic but in NM they are deviant and evil.
The good cops in NM are scared...once they become aware of the forces at play they just keep their heads down and wait for retirement.

Reply: The only name I feel comfortable posting, because it's public record, is Ray Duran, who moonlighted there as a DeeJay. He used the name RayJay as a disc jockey and drove a van that had R&J printed on it. (Odd coincidence, as you'll know if you've read the psychic reading in WHO KILLED MY DAUGHTER? that said, "Kait sends you the letters R&J as if printed on the side of a white van.")

The bartender provided a number of other names as well but those have not been confirmed. Some of the names the bar tender gave us are also names linked to the chop shop on Arno.

Reply: I don't think they would die because of telling us the truth. In fact, believe just the opposite -- people are safer once they've exposed the truth than if they sit on that truth and are walking time bombs who might explode an any moment. Once the truth is out there, they are no longer a threat. There's nothing to be gained by killing them other than to confirm that what they said was the truth.

If Kait had spoken out, she might be alive today.

Reply: About the position of the bullet hole in Kait's face coinciding exactly with the indentation she was born with -- I am as stunned as you are by that. You can varify it yourself by looking at the photo of Kait on pg. 348 of the paperback edition of WHO KILLED MY DAUGHTER and comparing it to the diagram of where the bullets struck. It does seem a lot to be coincidence that that indentation would be like a little bull's eye.

You probably have the names already based on the bartenders info. Your wedding party witnesses probably saw him/her.
Where can you possibly go from here?

Reply: No. We don't KNOW who killed Kait. We feel sure she was forced off the road by someone in a heavy car using the PIT technique, as evidenced by the damage to her rear bumper. a VW bug couldn't have done that. Nor could a Camaro. A police car could have. But another large car could have done it as well.

If it was a cop car, we don't know which cop was driving it.

We can speculate which cops were behind the cover-up, but we can't know for certain. So many of them have lied to us that we can't tell who is lying to protect himself/herself and who is lyiing to protect fellow cops.

We can speculate about who fired the shots that killed Kait. In fact, we feel pretty certain. But we can't prove that. And, as ordinary citizens, we don't have the authority to force the people who do know that to talk to us when they don't want to. If we try to contact Dung, he calls the police and reports us for harassment. Sharon refuses to speak to our investigator and If we write to her she threatens to sue us for harassment.

As for your final question -- that is blowiing in the wind.
