Stay Strong and Keep UpThe Good Fight

Question: I first read Who Killed My Daughter in the Summer/Fall of 1995. It was a book my girlfriend had laying around that her mother gave her. She had never read it, and I'm the type of person that will read anything. So I picked it up, having nothing else interesting to read at the time, and was instantaneously spellbound.

I had been living in Albuquerque for about 2 and a half years at that time. Since reading your book, I find my thoughts waft back to those incidents of 1989 periodically. Over the years I find myself always coming back to check in to see if there is any new information that has been released. I found the article New Mexico Citizens Fear Their Police, and driving home that night, for the first time I was more than a little frightened to be living here.

I was excited to read that you are working on a follow up to bridge the gap between Who Killed My Daughter and the present.

I just wanted to say "Thank You" for all that you have done. Not only in the service of your daughter, but for others that have experienced the depravity of the APD and other law enforcement institutions. My thoughts, prayers and hopes are with you and your family, who I hope will never acquiesce to the powers that be nor to the ravages of time.

All My Best
A Friend

Question: I admire your tenacity and determination. My question is, are you going to create a Facebook page about Kait and if not, why? It seems that Facebook would be an incredibly useful tool in helping to get the message out about her death, the cover-up and the corruption in New Mexico. Best wishes...

Asked on Tuesday, February 09, 2010 at 07:58:21 AM
Reply: No, I haven't done that. I think there are others who are sympathetic to our cause who have created such pages for Kait on their own. But I figured this Web site would be better than a Facebook page because it can be formatted to include so much information.

Kait Duncan

Question: Hi Lois. My name is Donna. I started reading your book "Who Killed My Daughter". My mother reads true crime devotedly, this is how I came upon your book. I am so sad to hear of your loss so long ago and I'm sure the pain never goes away. If I was a detective I would most assuredly give my time and effort to you to help solve your daughter's murder. The questions I have for you are first, do you talk to Dung now to try and get more information and second do you still talk to the psychics? Also, does that connection between you and Kait still exist? I am interested to know of any new information you have and am looking forward to your new book "The Tallykeeper" that will give us this insight. I keep you in my prayers and pray that one day soon you will solve this painful case. I will be passing this information in some way through my mother's facebook profile. Take care and please answer me soon. SIncerely, Donna

Asked on Thursday, February 04, 2010 at 04:41:30 PM
Reply: No, we've had no contact with Dung since November 1989 when his boss brought him over to our place to pick up possessions we had stored in our garage. At one point, many years later, we mailed him a copy of a flyer about a $25,000 reward we were offering for information about Kait's murder. His girlfriend called the police and reported us for harassment, (although we'd sent the same flyer to 200 people, including many of Kait's friends).

No, I'm no longer consulting psychics. That information was helpful to us in our initial personal investigation, but since police won't follow up on it and we can't use it in court, it seems pointless to continue along that path.

The connection between Kait and me seems to have faded with the years. It hasn't totally disappeared, but I get the feeling she's communicating from a farther distance.

APD Cold Case Unit

Question: Have you thought about goiing back to the APD Cold Case Unit and trying to get them to investigate Kait's case?

This morning's Albuquerque Journal showed Cold Case detectives Mark Wilson and Tod Babcock working at the scene to search for the body of Michael Synder from 2002.

Asked on Wednesday, February 03, 2010 at 11:02:32 AM
Reply: TOD BABCOCK is now a member of the APD Cold Case Unit?!!! No wonder they have no interest in investigating Kait's case.

Babcock is one of the cops linked to the auto body shop where the VW tried to take refuge after fleeing Kait's scene.

The owner of that shop, Frank Arellano, stated in a deposition that his buddy, APD Officer Tod Babcock, used the shop at 824 Arno after hours to fix his car. He also baby sat for the Arellanos.

the FBI and the local police

Question: Did the FBI ever become interested in trying to help you solve this crime or investigate the drug ring? Exactly what were the Albuquerque police afraid of? Did you ever find out who the VIP buying drugs was? Loved your book, wish you hadn't had to go thru it all. Colleen

Asked on Sunday, January 31, 2010 at 02:27:21 PM
Reply: We don't kno what may be going on behind the scenes with the FBI.

We can't imagine what APD could be afraid of, unless that some of their own people were either involved in the murder or protecting the criminal activities Kait was going to expose.

We don't know for sure who the VIP was, since so many political VIPs were/are involved in the NM drug scene.

how did you write this book!!!!!!!!!

Question: hi im a student in evans middle school i started to read who killed my daughter i really want to know how you had the bravery to write this book and another thing that i would what to know is who do you think killed her? how long did the investigation last?

Asked on Saturday, January 30, 2010 at 11:29:24 AM
Reply: Writing the book didn't take courage. It just took tenacity. I'd kept a journal right from the start, because I was afraid that, in my grief, I might misremember something important, so I made notes about everything that happened. and I recorded every phone conversation, so it was impossible to misquote anybody. (New Mexico was a state in which it was legal for one party to record a phone conversation without the other party's knowledge.) Then, as I said in the post below this one, I just sat down and did it. In truth, I can hardly remember writing that book. The words fell out of my fingers onto the computer keys and the words appeared on the screen as if they were being dictated by Somebody Else. This is the only book I've ever written where the editors never asked me to change a single word.

My own speculation, (and that's all it is -- a speculation), is that Kait was killed by a hired hit man, working in conjunction with at least one accomplice who drove the car. Paul Apodaca is one possibility, but there are others. The question is, who hired him and why? And who, at APD, was behind the police cover-up? I do not hold the whole department responsible. There were honest investigators, trying to do their jobs right, who were being blocked, given false information, and deliberately sidetracked.

The APD investigation, (if you can call it that) ended with the arrest of the Hispanic suspects in the spring of 1990. Despite the fact that, after charges against the Hispanics were dropped in the spring of 1991, DA Bob Schwartz directed APD to investigate the Vietnamese suspects, they would not do so.

Question: Hello! My name is Chase Woods and I'm in Middle School. I'm currently reading "Who Killed My Daughter?" I'm a big fan of your books, and to finish them all. I just wanted to say that I got upset about Kait's case. It hit me right at the heart because I have also lost someone close to me. My brother died in 1994 and i didn't even get to meet him. I'm going to read on in your book. It's a great piece of work. Also I'm an up-and-coming author. I"m working on my first book now. It's a murder mysterie. I wanted to ask if you have any advice for me?

Thank You,

just finished who killed my daughter

Question: I read many of your suspense novels as a teenager but I am glad I did not read who killed my daughter until now. as a teenager, your novels haunted me but I knew they were fiction. Now, at age 22, I have picked up all the books I could by you and have been re-reading them. When I realized what happened to your daughter Kait and that you wrote about it, I immediately got the book and read it. I just finished it and I can\'t say I loved it. In fact, I hated what happened. It\'s such a sad and horried story and it\'s not fiction. I got so angry while reading it because it seemed like nobody was doing anything or listening to you and that\'s hard to believe that we live in a world like this, where the people (like police) who are meant to protect you and find who killed your daughter, just don\'t. I don\'t understand. I am sorry so for what happened and I will always remember your daughter through what I have read about it, especially as I continue re-reading all your other books.

Question: This is Shannon again, I am sorry to keep bothering you. My report is tomarrow and im extremley nervous. When i read "Who Killed My Daughter" I saw all of your children's names and i can't remember them, and i don't have the book anymore. I was hoping you could tell me. I had to read 4 of your books for my project. i read "Who Killed My Daughter", "Gallows Hill", "Stranger With My Face", "They Never Came Home" My favorites were "Who Killed My Daughter" and "Gallows Hill" i loved reading about Kait's mystery and "Gallows Hill" because i love the Salem Witch Trials. I found it so interesting. I didn't expect to love your books so much, but i did, and hope i can continue reading more. I watched Hotel For Dogs, and saw you in the crowd and was like surprised, because i didn't know you were in the movie. i thought the movie was cute, but im going to read the book to compare. Thank You so much for talking to me.

Yes, I was an extra in the movie, HOTEL FOR DOGS. But I can't believe you actually picked me out in the crowd scene. I was on camera for just a fraction of a second, standing between two dog catchers.

Question: I'm interested in learning my psychic abilities after i read your book "Who Killed My Daughter?", any suggestions?

Asked on Thursday, January 28, 2010 at 09:55:21 AM
Reply: The metaphysical sections of large bookstores contain all sorts of books on that subject. Some are good. Some are hoaxes by scammers. I'm not in a position to sort those out for you.

Dr. William Roll and I collaborated on a comprehensive coverage of the subject in a book titled PSYCHIC CONNECTIONS: A JOURNEY INTO THE MYSTERIOUS WORLD OF PSI. That book is long out of print, but you might be able to find a used copy on Amazon.

Noreen Renier, the psychic you read about in WHO KILLED MY DAUGHTER?, who channelled those incredible pictures drawn by a police artist, has published two books under her own name. Those probably also are available on Amazon.

Question: Hi Lois, any new info that you are able to post on here? And how is The Tally Keeper coming along?

Asked on Wednesday, January 27, 2010 at 07:25:43 PM
Reply: No,, to the first question. Meaning, we do have new information, but nothing I'm free to post here.

THE TALLY KEEPER is in the hands of my agent. There are numerous legal issues to work out in regard to my pre-established commitments to various publishers, so don't expect anything to happen immediately.

I feel that God has set a time for that book to be published, and that's when it's going to happen.

Question: Was Ferman Garcia, owner of GO Video, aware in his drunken stupor that you now live on the east coast?

Asked on Tuesday, January 26, 2010 at 02:55:01 PM
Reply: I have no idea what he did or didn't know about me. When he posted this, I didn't even know who he was. (That post that he was so upset about was posted by somebody else a year or so before that. He must have Googled his own name and stumbled upon it long after the fact.)

Of course, after reading his death threat, I've had him checked out. He was manager of Go-Video at the time of Kait's death. He DOES have three sons on the force -- Eric, Danny and Allen. Eric was the APD gang supervisor.

I'm a 13-year-old girl.. & Me, I love too read, but this book caught my eye.. I keep reading all your books, they are so interesting. I would not be able too live through what you have gone through. You stayed strong, & I hope one day, that I can meet you! :)

Question: I just wanted to let you know that as long as you have breath in you, don't give up. God is good and he will see that justice is done. I don't know how the people that are behind this can sleep at night. Everything that is done in the dark will come to the light. They will have to answer rather it is here on earth or in heaven. This is my first time hearing about this and I must say I did not find it hard to believe. There is so much wrong in this world. Know that no one can hurt her anymore and she is in a better place. Know that she is right there with you. I hope that you can find some comfort in that. I don't pray all the time but I will say a prayer for you and your family. I am so sorry that you had to endure so much pain.

Question: Mrs. Duncan -

I remember reading all of your books voraciously when I was about 13, including Who Killed My Daughter. I'm 24 now, and for some reason today I remembered your daughter's case, having not thought about it nor heard anything for 11 years. I did a google search, hoping that in the meantime there had been some sort of resolution. I am so sorry that there hasn't been formally. I hope that you and your husband are gathering information that, even if you can't share it publicly and even if it never results in a formal conviction, helps you to have closure. It's so disheartening to see the lack of cooperation with the police. I guess all anyone can do is have faith that things will work out the way they are meant to, whether that means this monster getting justice now or in the next life. My prayers are with you, and other families who have suffered tragedies like this.

Reply: Thank you for caring enough to follow up on this, Leigh. Please keep checking this message board. People with knowledge occasionally post revealing statements here, either because they are good people who want to help us or because they are angry enough at the material posted on this Web site so they react violently and say too much.

One of the latter was Ferman Garcia who, on
8/26/08, posted, ""Take my name and GO Video (the business he owned when Kait was killed) off your website or you just as dead aS your daughter. I have connections with APD and the sherriffs dept. fuck with me you will die bitch."

Ferman Garcia does have three sons at APD. I don't imagine they were very happy about his post.

THE GARRITY LAW

Question: This post is by Lois.

I hope that you alll will go to the Real Crimes web site at www.realcrimes.com and read the newly posted case about the murder of Paul Fitzjerrel in Gallup, NM. Like most people, (apparently even the prosecutor, Bob Schwartz), I wasn't aware of the Garrity Law -- a special, protective right awarded to police officers to prevent self-incriminating statements from being used against them in court.

The police union counsels all their members to insist on Garrity whenever they are accused of crimes. “By doing so you will ensure that your statements and reports cannot be used as evidence against you in any proceedings before any agency bound by the rules of evidence,” says the FOP guide sheet. “Our advice is that we all use the procedure all of the time.”

That law should be stricken from the books!
