Corrupt cops..
 
Question: Wasn't T.Babcock a friend/partner of Rock Hart? Those two plus many more (in their circle of trust) were accused of being more than crooked! Intimidation, sexual favors from prostitutes in order to avoid arrest, physical abuse of people they wanted information from, threats if certain people didnt "Cooperate." Yeah, a REAL good group of guys! Im glad im not living that life any more. They had a reputation that was WELL known on the street. NOT in a good way either.

Reply: I don't know if there's a link between Tod Babcock and Roch Hart. (It would be fascinating if there were, since Hart has posted many times on this Web site, offering guidence on how we should and should not conduct our investigation.)

I would be very interested in knowing the identities of others in "their circle of trust." If you don't want to post those names here, perhaps you could send them by private e-mail?

Question: Hello Lois,

I hope you are well. I have been doing some more deep reading and thinking about Kait and if there was one thing that most women could not or would not put with is if they found out about a peadophile ring as well as drug smuggling. In a lot of countries child stealing is rife. If Kait had found out about it on top of the drugs which she may have been prepared to let go of it may just have tipped her over the edge and she was so obviously fearful of something or someone.
What do you think? I mean you know a lot more having done all the investigations.

Reply: Your speculation about pedophile activity is not impossible. In those days a lot of stuff from the Orient -- drugs, of course, being primary -- was being smuggled into the States by various means, (often by UPS). We've been told that members of Dung's group were receiving child porn from the Orient and selling it to a local video dealer. But that's just hear-say -- we don't have anything to back that up, other than for the owner of an Albuquerque video store posting a crazy message on this board threatening to have me killed if I mentioned his name or the name of his store on this Web site. (And then the idiot signed his name.)

The accusation of "child stealing" has never been made, and we have no reason to suspect that could have been happening.

Cold Case Task Force
 
Question: Some are as corrupt as the next APD cop. I wouldn't trust any of them.

Maybe the new mayor can help you out.

Reply: I don't think Det. Don Roberts is corrupt. We had high hopes when he was in the Cold Case Unit. But as soon as he began to get deeply involved in Kait's case and started to interview suspects, he was transferred to the Pedophile Unit.

Question: First, I would find out who the instructor is first before you share any info with him. Many retired APD officers have gone on to teaching/training.
I know one for a fact has done so, name Damen Faye. So watch who you confide in.

If this gentleman's instructor is a former member of APD and takes an interest in the case, more power to him. Even if he's Damon Fay.

Question: Ma'am I have never read an entire book in my life! Back cover was good enough for me thanks to my Criminal Justice instructor our entire class must read and write a paper by end of semester in which we are required to tear apart and magnify any possibilities we observe while reading.
I was also a corrections officer in Santa Fe Maximum security unit and Matthew Griffin often bragged how he ran this city how he had control over who lived and who didnt. I know for a fact Albuquerque Police Department is very corrupt. I hope and pray we can assist you in solving this if not maybe the next class can!

New detectives assigned to cold cases.
 
Question: Lois, Its my understanding that APD has now added 8 people to work cold cases. This might be a great time to push to have your daughters case opened back up.

Reply: One of those 8 new members is a cop named TOD BABCOCK.

Babcock is one of the cops linked to the auto body shop i.e. drug distribution center at 824 Arno where the VW tried to take refuge after fleeing Kait's scene.

The owner of that shop, Frank Arellano, stated in a deposition that his buddy, APD Officer Tod Babcock, frequented the shop after hours. He also said Babcock babysat for him and his wife.

I don't think the Cold Case unit is going to be investigating anything that one of their own members was personally involved with.

Since your teacher is introducing her students to my books, she might be interested in the 35 minute DVD, "A Visit with Lois Duncan," which was created specifically for classroom use. On it, I describe Kait's murder and my writing of her story. Please, tell your teacher about that site. After reading that book, you probably feel as if you know our whole family, so it might be interesting to you for that reason also. Daughter Robin filmed and edited it; daughter Kerry interviews me; Robin's husband does the introduction; his brother and Robin created the music; and my husband (Kait's dad) is on there also. (Of course, we're all 20 years older than when that book was written.)

Question: You and Kait saved my life. When I was very depressed over the death of my husband , my girlfriend gave me your book " Who Killed my Daughter?" From there I found your website, and you put me in touch with Shelley Peck who gave me the strength to go on. That was more than 10 years ago, but I think of her and you often. I don't think I'd be here if it wasn't for you, the pain was too much, and the hopelessness was worse. I hope that Kait knows from the Other Side that you and she and Shelley saved me. Reply: I think she was shot by a hired killer. It might have been one of the Hispanic suspects that the police arrested; it might have been Paul Apodaca or one of his accomplices, his brother Mark or friend Lee Padilla, whom he says he was with that night); or it might have been somebody else altogether.

The big question is: Who hired the shooter, and what was Kait prepared to expose that was so important that she had to be taken out?

Reply: That same question was asked a few posts down. My response is the same -- Kait's story was filmed for segments of Unsolved Mysteries and of Sightings, but it hasn't been a major motion picture.

Reply: The only news I'm free to disclose about Kait's murder is on this Web site. And a lot of it is included in posts on this message board and in my responses. So, if you're truly interest, read back through some of the earlier posts. There's interesting stuff there.

I'm delighted that you and your friends like my books enough to form an after-school book club based upon one of them. DON'T LOOK BEHIND YOU recently went out of print, but is going to be republished very soon by a different publisher. In the meantime, there still may be copies available on Amazon.com.

Reply: Not a full length feature film. But it was featured on both Unsolved Mysteries and Sightings. The Unsolved Mysteries segment has gone into syndication, so it occasionally pops up unexpectedly on the Lifetime Channel. It's always a shock, because there we are being interviewed -- Det. Gallegoes, reporter Mike Gallagher, and myself, all 20 years younger than we are today. The problem is that the segment was filmed right after the publication of WHO KILLED MY DAUGHTER?. So it doesn't include any of the new information that is on this Web site.

Night of the shooting questions
 
Question: Hello Mrs. Arquette!
I have followed your message board on and off through the years. I paged back over the past year\'s messages and caught up this weekend, and there are a couple of things I am curious about.
1. Had Kait updated her driver\'s license or vehicle registration to reflect her new address? (I never updated my info until after I graduated from college, but maybe that\'s just me..) If she had not, how did the police end up at her apartment to notify Dung? Did you ask them to inform him after they informed you? Or did they backtrack, using the directions in the car, and tell Sharon Smith before even you had been notified? And if so, did she direct them to Dung and then phone him? (Perhaps how he knew before the cops officially told him.)
2. Who actually called for the ambulance? If I understand, Mary Ann Wallace SAID she called for backup (but didn\'t) and Merriman SAID he called for an ambulance (but didn\'t). So where did the call for the ambulance originate from?
3. Was Kait still buckled in, or was there autopsy finding of any head/chest bruising from being flung forward against the steering wheel or being caught by the seat belt?
Just things I wondered about as I looked at the photos and read up. I can\'t tell you how sorry I am for your loss, and how sorry I am that the people who are supposed to help are, likely, the culprits themselves. I hope you all are well.

Kait's driver's license still gave the address of our family home (which is how the hospital was able to contact us). Police got her apartment address from Sharon Smith, whom they talked to before they talked with us at the hospital. I may also have given Det. Gallegos that address at the hospital.

No, the cops didn't phone Dung before going to the apartment at 3 a.m. They allegedly "woke him up" when they arrived to tell him.

It's not totally clear who actually called for rescue. Merriman says he did, and no one disputes that, so he may well have done so. However, the ambulance that arrived first at the scene was already in the area when the call went out, which is why it got there before the fire rescue team.

There's nothing in the reports to indicate that Kait was buckled in. Actually, she couldn't have been, or she wouldn't have fallen sideway across the seats. So she either hit the pole, undid her seat belt in order to get out, and was shot before she could do so, or she wasn't wearing a seatbelt at all. (That would not have been unusual for her. she didn't always buckle up as she should have.)

Question: I just read your book for the first time. I had no idea this tragedy happened so long ago! Did you ever find the young man that Kait may have met that night? Or the old boyfriend, Rob? I am praying that those whose lives have been ravaged by fear because of what they know will come forward and be freed by the truth. Is there anyone with integrity in authority that they would be able to give information to that would actually do anything at this point? My prayers are with you and your family. I'm so sorry for your lose. Thank you for speaking out against corruption and injustice.

Yes, there is a place for tipsters to go to talk to someone in authority. They can go over the heads of APD and go straight to the FBI. The FBI already has a file on Kait's murder.

Question: Dungs friend/alibi was with kirtland afb. thats the easiest and safest way to get drugs in. so the cover up is for agencies/people higher than the apd.

Reply: That's an interesting speculation and a possibility that has been suggested to us before. Past employees at the NCO Club on Kirtland AFB and servicemen stationed at Kirtland in the late 1980s, describe a large drug operation in which drugs from Puerto Rico and Antigua were flown into the US by para-rescue teams, who would stop at Kirtland for refueling before proceeding on to California. Sources say those drugs were distributed in the main NCO Club and adjoining lounges. Sources have identified a group of APD officers, who frequented the (NCO) Roadrunner Lounge and solicited women to attend late night parties at the auto body shop where the VW Bug fled after leaving Kait's scene.

We feel sure Kait's murder was linked to her knowledge of the New Mexico drug scene. But there were so many facets of that scene that it's difficult to pinpoint any particular one as the direct cause of her death.
