Question: do you feel that this case has come significantly closer to solving this mystery within the past 2 years? Also...maybe you should make a myspace for people who want to connect to you to help solve this case. Just advice...considering almost everyone has a myspace these days including politicians to music artist...just a thought...if you would rather not that is okay!! Reply: Yes, the past two years have brought us a lot of important new information. However, if the police are unwilling to follow up on it, the case can't be officially "solved."

This Web site and message board serve the same purpose as a "Myspace." People with knowledge about Kait's case run her name through Google and land here.

I don't know much about "My Space." I assume that anybody who wants to post under a pseudonym can do that, even if the name they're posting under is a dead person.

Maybe it's a friend of Kait's who wants to get information. Or maybe it's a prankster.

Question: Dear Mrs. Arquette,

My question is; is it possible for you to sue the APD, under the Freedom on Information Act regarding the tips they refuse to reveal on that website; or even in a civil lawsuit for their millions of mistakes and bungling of your daughter's case; to being negligible in that their incompetence and unwillingness to follow up thoroughly? I know you would be uncomfortable with it; but if it helped; you could use the money to start a foundation in Kait's name.....
Has anything come of Chief Judge Brennan's arrest? Its a pity judges can't be tried for errors on the bench....

Reply: When it became evident that our only hope of obtaining the photographs from the second day work-up on Kait’s car would be to file a suit against APD, we made a trip to Albuquerque to meet with attorneys who had a history of suing the City. We were up front about the fact that our goal was to take the case to court so we could subpoena copies of case materials.

One attorney after another told us they weren't interested. The last one we met with was compassionate enough to tell us why.

"No attorney will take on this case with that stipulation,” he said. “True, there are those of us who have built our practices on suing the police, but we always settle out of court. The City has set aside a large amount of money for settlements with no admission of wrongdoing. That's the way it's done here."

Later the City Council commissioned an independent study "in the context of a serious and ongoing community crisis regarding the performance of the APD.” The study revealed that the city sets aside $4 million per year to settle claims against APD. Since the largest portion of those settlements goes to attorneys, it’s easy to see why they might be reluctant to upset that well-laden apple cart.

Judge Brennan resigned from the bench before he could be suspended, so he's eligible for retirement benefits. He went to the Betty Ford clinic and, upon his return, pleaded guilty to DWI and possession of cocaine. He was sentenced to a year’s probation and two days of house arrest and given a conditional discharge on the drug charge, so the felony conviction will eventually be removed from his record. His lady friend also pleaded guilty and received the same “punishment.” By entering guilty pleas, they avoided trial, which meant they never can be forced to disclose where they were that night or identify their drug suppliers.

I don't know where he is right now. There are rumors that he's working for his friends, the Maloofs, but I don't know that for a fact.

And a lot of good people have been trapped in it, including honest cops who know the truth about what happened but are prevented from doing the right thing because they are bound by the Blue Code of Silence.

Reply: There appear to have been several groups of people at the scene when Kait was shot.

From the report of the witness who drove past the scene minutes after the shooting (see the message a few below this one) a police officer was there.

My personal belief is that Dung did not kill Kait, but your suggestion that his friends did cannot be discounted. Dung and his friends must have been there at the time of the shooting, because Dung was calling people, hysterically telling them, "Kait's dead! They shot Kait!" three hours before police broke the news to him.

Paul Apodaca was there. As was the person who drove off in Paul's VW Bug, leaving Paul at the scene to greet Det. Merriman when he arrived.

The Hispanic suspects who were arrested and then released -- Juve Escobedo, Miguel Garcia, and Marty Martinez -- may or may not have been there.

No, we don't live in Albuquerque any longer. After WHO KILLED MY DAUGHTER? was published, we received death threats to the rest of the family. My husband took early retirement from Sandia Lab, and we relocated.

We still have contact with Betty as a personal friend. We are no longer getting psychic readings. We feel we got all we were supposed to receive from psychics and what we need now is hard evidence or information from people with knowledge who trust us when we guarantee we won't reveal their identities.

A witness who drove by the scene right after the shooting saw a uniformed officer standing at the open driver's door of Kait's car as if he was checking on her. Kait was upright behind the wheel, (the witness mentioned noticing her "bloody hair."

According to police reports, that officer wasn't there when Det. Merriman (plain clothes, unmarked car) stumbled onto the scene minutes later. Merriman and Officer Wallace both reported finding Kait prone across the two front bucket seats with her head against the passenger's door.

So, who was that uniformed officer and where did he go? Why didn't he report the shooting or stay with the victim? Did he cause Kait to topple over when he checked for a pulse?

So many questions.

We can't post anything that endangers them. However, we do have our PIs follow up on what they tell us. If we can verify that information on our own, through some outside source, without having to involve the tipsters, then we can post it.

Question: this question has been bugging me ever since i finished reading Who Killed My Daughter? about a year ago. now im into chapter 7 of Don't Look Behind You! and i was wondering how the psychic could have described MIKE VAMP a fiction character. that just doesn't make any sense to me whatsoever. i no that u probably don't no either, but i was just wondering. how a fiction character could be the killer of a real person. now i have read a lot of Nancy Drew mystery books, and i love the suspense,and im actually very good at solving the cases, but this is one case i just don't get.

Reply: I agree, this is confusing to those of us who are not psychic. All I can do is tell you what I have been told by people who are (or who claim to be) psychic.

They say that information they receive psychically often comes to them in the form of images or symbols. For instance, in Chapter Eleven of WHO KILLED MY DAUGHTER?, when I asked psychic Betty Muench, "Would it be the right thing to turn all our information over to Mike Gallagher, investigative reporter?" she did a reading by automatic writing that said, "There is an image of a flatbed with a great bomb on it." As you can see from the copy of that reading in my book, she actually drew a sketch of that image on the corner of the page. She went on to say that the "bomb" was an image of Mike's energy, and he would "appear at first to be overkill" but would "cause some kind of intimidation" which would "cause a great headache" to those involved in the cover-up.

That's exactly what happened. Mike exploded the "random shooting" theory by doing his own investigation and writing an indepth story about his findings. That started events in motion that eventually led to charges against the Hispanc suspects being dropped. That caused APD "a great headache."

The image Noreen Renier received of "Mike Vamp" from my novel DON'T LOOK BEHIND YOU is also symbolic. "Mike Vamp" was a hired hitman who worked for international drug smugglers. Noreen interprets the sketch the police artist drew of "Mike Vamp's" face as a symbol conveying the message that Kait was killed by a drug smuggler's hit man like the one in my book.

The Nancy Drew mysteries are fiction, and the authors make them simplistic because they're written for young readers. Real life doesn't follow the rules of plotted fiction. I wish that it did.

Question: I have been reading some of these posts and started to ask my husband some questions. My husband retired from the Albuquerque Police Department several years ago and knows some of the officers you mentioned. He was very reluctant to speak about the murder and at times was frustrated with my questions. This gave me the impression that perhaps there was something secret about the events and/or some cops were either afraid or trying to protect other people. I to this point I can’t figure it out. In my opinion I think he private investigator you hired has done a poor job, as I have uncovered some interesting facts just by asking a couple of questions.

The bodyshop was a frequent hang-out for APD officers. Officer Mary Ann Wallace use to be a regular at the bodyshop and was very close to a lot of the officers there. Wallace criticized the investigation in the unset. During the murder she was girlfriend and roommate of Officer Alex Marentas. Marentas was a field investigator and on duty at the time of the murder. It is very likely that he assisted in processing the scene, this would be normal for such a scene, but not officially documented as being present. At the time he was also a very powerful union leader who had ties with Manny Aragon and would ultimately became President of the union.

Not sure if this is helpful, but somehow I think these facts seem important.

Question: I have just finished your book and feel so badly for your family. I have never heard of this case before probably because I was only 9 at the time and that I live in Pennsylvania. I do want to give my prayers and condolensces to the family and friends. God knows who killed your precious daughter and He will be the ultimate judge. I know that until the case is solved your family will have no closure. So I say to you keep going from day to day and know that in the end justice will be served if not on this earth then in Heaven.
